New Zealand has some of the most generous recreational gold mining laws in the world. However, the line between "having a bit of fun" and "illegal mining" can be blurry. Here is the definitive breakdown for 2026.

The Key Difference

Fossicking (Recreational)

  • Where: Only in 19 designated "Fossicking Areas" managed by DOC/NZPAM.
  • Tools: Hand tools only. Pans, sluices (non-motorized), shovels. No excavators.
  • Rights: You do not own the ground. You cannot stop others from panning next to you.

Mining Permit (Commercial)

  • Where: Specifically defined polygon of land granted to YOU by the Crown.
  • Tools: Whatever your permit allows (excavators, dredges, pumps).
  • Rights: You have exclusive rights to the minerals. You can trespass others from your claim.

The "Hand Tools" Rule

This is where most beginners get caught out. Under the Crown Minerals Act, fossicking is strictly limited to non-motorized methods.
